Migrant workers collecting 121,500 baht after mediation with employer

Concerning the violation of labour protection law at the Phuket Labour Court Region 8

 

On 17 May 2022, the employer of Mr. Tin Ko U, a migrant worker from Myanmar, has filed the case against labour inspector of the Phuket Labor Protection and Welfare Office with the Phuket Labour Court Region 8. The court was asked to quash the order of the labour inspector no. 82/2565 which compels the Happy Holiday 24 Co. and its managing director authorized by the employer to provide compensation to Mr. Tin Ko U for his work in December 2021 and from 1-15 January 2022, and expenses for food, gas, services, annual leave pay, special severance pay in lieu of advance notice and compensation, for the total amount of 152,240 baht plus interest at 15% per annum until the amount is fully paid.

On 7 June 2022, the Phuket Labour Court Region 8 scheduled a mediation during the trial with an attorney from the Human Rights and Development Foundation (HRDF), authorized by Mr. Tin Ko U to participate with representatives from the employer and the mediator. During the mediation, the employee agreed to accept from the employer the amount of 120,000 baht plus 15% interest rate per annum or 1,500, altogether 121,1500 baht.

On 15 June 2022, Mr. Tin Ko U has come to HRDF office in Phuket to collect the amount of 120,000 baht as ordered by the Court and from the deposit his employer had placed with the Court. As to the interest amounting to 1,500 baht, Mr. Tin Ko U has received it since the day the mediation was taking place.
