Yet, a number of them are employed in informal sector\u2026making them ineligible to labour law protection and proper social welfare causing an impact to the labour and economic sectors and the nation\u2019s economic stability\u201d<\/em><\/strong><\/p>\n\n\n\n<p><strong><em>Key issues<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>Labour rights violation by employers including being denied overtime pay, unfair dismissal, unpaid sick leave, and verbal pressure.&nbsp;<\/em><\/li>\n\n\n\n<li><em>Limited access to rights and information, as number of workers are not aware of their basic rights and dare not demand and complain.<\/em><\/li>\n\n\n\n<li><em>Structural complexity as workers without employers are not able to apply for social security invoking Section 33 and pregnant workers can only afford private health insurance and are not aware\/certain about their maternity leave.&nbsp;<\/em><\/li>\n<\/ul>\n\n\n\n<p><em> <\/em><strong><em>Findings<\/em><\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong><em><u>Problems stemming from employers\u2019 treatment:<\/u><\/em><\/strong><strong> <\/strong><em>Testament to how labour rights violation persists.&nbsp;<\/em><\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><em>Lack of overtime pay: <\/em><\/strong><em>Manufacturing workers are denied formal OT, yet have to take on more work than normal time.&nbsp;<\/em><\/li>\n\n\n\n<li><strong><em>Employers\u2019 wage discrimination during their medical leave<\/em><\/strong><strong><em>: <\/em><\/strong><em>Certain groups of workers are denied paid sick leave.&nbsp;<\/em><\/li>\n\n\n\n<li><strong><em>Employers\u2019 verbal pressure and humiliation<\/em><\/strong><strong><em>: <\/em><\/strong><em>Creating psychologically unsafe working environment&nbsp;<\/em><\/li>\n\n\n\n<li><strong><em>Employers\u2019 unfair dismissal: <\/em><\/strong><em>Employees are denied special severance pay in lieu of advance notice<\/em><\/li>\n<\/ul>\n\n\n\n<p><strong><em>\u201cAll of these reflect&#8230;weakness of regulatory mechanisms and the enforcement of labour law in practice.&nbsp; <\/em><\/strong><strong><em><\/em><\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong><em>&nbsp;&nbsp;&nbsp;&nbsp; <\/em><\/strong><strong><em>2<\/em><\/strong><strong><em>. <\/em><\/strong><strong><em><u>Migrant workers are scantly aware of labour rights and human rights:<\/u><\/em><\/strong><strong><em> <\/em><\/strong><em>Despite outreach effort, workers in various areas are found to either lack \u201cunderstanding\u201d or have \u201cmisunderstanding\u201d. Therefore, it is necessary to reach out to them multiple times to ensure local workers understand and are able to effectively apply the knowledge.<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><em>Migrant workers are unaware of social security benefits<\/em><\/strong><em>: <\/em><em>Unaware as to how to apply for medical benefit, child delivery, or income compensation.&nbsp;<\/em><\/li>\n\n\n\n<li><strong><em>Migrant workers eligible for social security benefits, but dare not demand \/unaware of complaint mechanism<\/em><\/strong><em>: <\/em><em>Lack of regular advice on complaint mechanism and lack of leaders or collective bargaining fearing of losing job, and therefore dare not make demand or fight for their rights.&nbsp;<\/em><\/li>\n<\/ul>\n\n\n\n<p><em>\ud83d\udccc<\/em><em> <\/em><strong><em>Workers\u2019 doubts<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><em>Workers without employers: <\/em><\/strong><em>Workers want to know if they are eligible to apply for social security by themselves?<\/em><br><strong><em>Answer: <\/em><\/strong><em>No, they cannot apply for social security invoking Section 33 since they need to have employers to help pay contributions.<\/em><\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><em>Lack of social security for female workers during pregnancy: <\/em><\/strong><em>Only have access to private health insurance from employer \u2013 Workers not certain about detail of their child delivery benefits?<\/em><br><strong><em>Answer: <\/em><\/strong><em>Depending on insurance policy, have to inquire employer or insurance company<\/em><\/li>\n<\/ul>\n\n\n\n<p><strong><em>\u201cThe above uncertainty reflects&#8230;.the need to ensure easy-to-understand information&#8230;on a regular basis and being friendly to workers\u201d<\/em><\/strong><br><br><\/p>\n\n\n\n<figure class=\"wp-block-image\"><img alt=\"\" loading=\"lazy\" decoding=\"async\" width=\"738\" height=\"328\" src=\"https:\/\/hrdfoundation.org\/wp-content\/uploads\/2025\/12\/20251216-03.png\" alt=\"\" class=\"wp-image-8152\" srcset=\"https:\/\/hrdfoundation.org\/wp-content\/uploads\/2025\/12\/20251216-03.png 738w, https:\/\/hrdfoundation.org\/wp-content\/uploads\/2025\/12\/20251216-03-300x133.png 300w\" sizes=\"auto, (max-width: 738px) 100vw, 738px\" \/><\/figure>\n\n\n\n<p><strong><em>Findings in brief<\/em><\/strong><\/p>\n\n\n\n<p><em>Key issues found concern employment, leave, lack of knowledge about rights and access to information\u2026On employment&#8230;Workers have to take on more work without receiving overtime pay. Samut Sakhon Chapter, Human Rights and Development Foundation, 2025<\/em><\/p>\n\n\n\n<p><strong><em>Issues concerning protection of migrant workers, the case of informal labour \u2013 Thailand<\/em><\/strong><\/p>\n\n\n\n<p><em>From conducting outreach to community and assisting migrant workers to have access to services, <\/em><em>labour law, social protection and their own rights, we have found 16 case studies of <\/em><em>migrant workers employed in informal sector who have received our assistance from various occupations<\/em><em> (<\/em><em>manufacturing, construction, fishery, service, agriculture) and found that informal labour widely face employment insecurity, lack labour law protection and basic welfares.
